Title 5 Information

The purpose of this page is to give clear and concise information on Title 5 as it relates to the selling of a house.  It is extremely important that both the homeowner and real estate agent are familiar with the rules of Title 5 and Duxbury's supplementary rules to Title 5.  Misinformation and poor communication can cost the seller time and money.  If you have any questions after reading the information on this page call the Duxbury Board of Health office at (781) 934-1100.

Duxbury requires a Title 5 inspection for any addition greater then 50 square feet even if it does not increase flow to the system.  A list of inspection requirements for building permit applications is located on this page.  Cesspools are automatic failures and all seepage pits must be located, opened and inspected.  Pits are evaluated under the same Title 5 criteria as cesspools.  Refer to the inspectors memo below for more information.  The Health Agent may require a soil evaluation by a DEP certified soil evaluator for any Title 5 inspection.  If you are not familiar with the town call the Health Agent for information on groundwater and soils.  You should also check the real time well data for Duxbury well #79 to determine if groundwater adjustments are needed.
