RDA Filing Requirements

REQUEST FOR DETERMINATION OF APPLICABILITY (RDA)

FILING INSTRUCTIONS

All required application materials must be delivered by mail or in person to the Duxbury Conservation Commission at Town Hall.

An electronic copy must also be emailed to Conservation@town.duxbury.ma.us

Step 1: Fill out the Permit Application

For a Request for Determination of Applicability - Form 1 (RDA) is available for download through the MassDEP website.

For Emergency Certification (i.e.: a tree that poses a hazard) Please contact the Conservation Department for guidance and/or Emergency Certification. Please note that filing an RDA may still be required.

Step 2: Submit Application Materials to the Duxbury Conservation Department

Plan your submission date based on the hearing schedule. The Conservation Commission holds meetings on the 2nd and 4th Tuesday every month.  Applications are due 21 days in advance of the Commission’s meeting.

Please complete the following to the best of your ability if you do not have a representative to submit on your behalf (engineer, contractor, etc.). The Commission will accept sketches, photographs, and GIS images from residents who do not have a site plan and are planning a minor project. Contact the Conservation Department for questions and assistance.

RDA application – two (2) paper copies and one digital copy

  • Original signed WPA Form 1 (RDA), one paper copy, and one digital copy
  • Check made payable to “Town of Duxbury” for $250
  • Check made payable to “Duxbury Clipper” for $50.00 for legal advertisement
  • Copy of plot plan with wetlands and area of work

Project Narrative - two (2) paper copies and one digital copy

  • Include owner info, address, parcel ID and date
  • Resource area description & delineation details
  • Executive summary of existing & proposed conditions with closest point of disturbance to Bordering Vegetated Wetlands
  • Construction sequencing & staging plan

Plan Set @ 1 =10’ or 1”=20’ – two (2) FULL SIZE copies and one digital copy

Plans MUST include:

  • Title block with applicant’s name, project address, map-block-lot, scale and date
  • Wetland Boundaries, 50’ Buffer & 100’ Buffer
  • Existing Conditions and Proposed Work
  • Parcel lines, easements, structures, pavement, edge of lawn, canopy tree line
  • Topography and grading if relevant to the proposed project
  • Septic system, stormwater and drainage infrastructure
  • Limit of work, erosion controls and topsoil stockpile area
  • Closest distance point of disturbance to wetland area

Step 3: IMPORTANT: Submit your Application to the Department of Environmental Protection

One copy of the entire submission (described above) along with photocopy of the checks submitted to the Town and the State to: DEP Southeast Regional Office, 20 Riverside Drive, Lakeville, MA 02347

Step 4: You will be Given a Hearing Date and Time by the Duxbury Conservation Commission

After submitting a complete RDA application (see items listed in Step 2), you will be scheduled to attend the next available public hearing. Incomplete applications will not be accepted by the Conservation Office. The applicant or their representative must be present at the scheduled public hearing.

Step 5: Attend a Public Hearing

Applicant/representative must present the proposed project to the board and answer questions.

Step 6: Receive a Determination of Applicability and READ IT

If you have any questions, contact the Conservation Department. Whether a permit is issued or denied, any abutter, the applicant, or a 10-citizen group may follow separate provisions for appealing the decision under the Wetlands Protection Act.

Pre and Post Construction Reminders

  • Contact the Conservation Commission to schedule a pre-construction site meeting
  • Complete the work within 3 years
