Fences

Installation of a fence over 7 feet requires a Building Permit per 780 CMR 9th Edition of the Massachusetts State Building Code.  It is not necessary to obtain a permit for a fence that is 7 feet or less in height.

It is suggested that you install the fence 2 or 3 ft from your side and rear property lines so you can maintain both sides of the fence without going on your neighbor's property.

Front Setback:

• Determine where the road ends and the property begins and move in 5 ft.

Corner Clearance:

If the property is on a street corner, the fence must adhere to the 15 ft corner sight clearance:

• On a street corner, for 15 ft in both directions,the fence must drop to a maximum height of 3 1/2 ft.
• On the property, within the 15 ft triangle, no structure or foliage shall be between the heights of 3 1/2 ft and 8 ft.

Pool Fence Requirements:

• If the pool is deeper than 2 ft or larger than 250 sq ft, a building permit as well as a 4 ft minimum fence is required — it must be non-climable, self-latching & self-locking.
